General terms and conditions
Translation — the French text prevails. French version. Version in force of 18 October 2026.
Version of
Part A — For all clients
A1. Who, what. Fiplan is online financial planning software, published by VAGA MART ("Fiplan", "we"), whose full identity is given in the legal notice. The contract binds Fiplan and the person who opens the account ("the client"). It consists of these terms, the privacy policy and, for professionals, the data processing agreement.
A2. The service. Fiplan helps prepare financial plans: entry of assumptions, accounting journal, financial statements, taxes, analyses, PDF reports and Excel workbooks, client area, monitoring and valuation, depending on the plan chosen. Fiplan evolves: we may add, change or remove a feature, without materially reducing what the client has paid for the current period.
A3. Fiplan is a tool, not advice. The calculations follow Belgian accounting and tax rules as we know them on the date of the version, with their sources cited in the application. They depend on the assumptions entered by the user. The client checks the results before using them or handing them to anyone; the client remains solely responsible for the plans, opinions and documents they produce or hand over.
A4. The account. The client gives accurate information and keeps it up to date. The client keeps their credentials secret and is answerable for what is done with their account and with those of the users they invite. Two-factor authentication is offered to everyone; we recommend it. The client informs us without delay at support@fiplan.be of any unauthorised access.
A5. The trial. The trial lasts 7 days, for 3 active files and 1 user. A bank card is requested at the start; nothing is charged before day 8. During the trial, documents bear the mention "Trial version" and cannot be downloaded. A client who does not wish to continue cancels before the end of the trial: nothing is invoiced. One trial per VAT or company number, and per person for a private individual.
A6. Prices and payment. Prices are those of the Pricing page on the day of the order: excluding VAT for professionals, including VAT for private individuals. Payment is made by card, via Stripe, at the beginning of each period (monthly or annual). The invoice is sent by e-mail. If a payment fails, Stripe retries it for about two weeks; after that the subscription ends and article A10 applies.
A7. Plans and volumes. Each plan gives access to the same features; only the number of active files, users and client accesses changes. An archived, delivered or binned file does not count. A change of plan applies immediately to the volumes and, for the price, at the next renewal, without proration.
A8. Price change. We announce any price change by e-mail at least 30 days before the renewal concerned. A client who refuses it terminates before that date, at no cost.
A9. Term and termination. The subscription renews automatically for the same term (one month or one year). The client may terminate it at any time from Settings › Subscription; termination takes effect at the end of the paid period. We may terminate or suspend the account, after an e-mail that has remained without effect for 8 days, in the event of a serious breach of these terms; without notice, in the event of fraud, a security breach or illegal use.
A10. After the end of the contract: your data. When the subscription ends, the account moves to closed access: the client can still resume a subscription or download all their data (structured, machine-readable format) for 30 days. After that, the firm and its data are deleted; technical backups are erased by rotation within the following 7 days. No fee is charged for retrieving one's data or switching to other software; a termination notice never exceeds two months (Regulation (EU) 2023/2854 on data).
A11. Permitted use. The client uses Fiplan for their legitimate activity, in compliance with the law and professional secrecy. The client undertakes in particular not to copy, decompile or resell the software; not to circumvent the volumes or protections; not to overload the service; not to share a user access between several people; not to enter unlawful content into it. The client is answerable for the lawfulness of the data they enter, including that of their own clients.
A12. Availability and support. We do everything we can to make Fiplan available and reliable, without guaranteeing an availability percentage. Planned maintenance is announced in advance and scheduled, as far as possible, outside office hours. Support answers by e-mail (support@fiplan.be), on working days, as quickly as possible.
A13. Liability of Fiplan. We are liable for damage caused by our fault in performing the contract, within the following limits:
- our total liability, for all damage combined, is limited to the amount the client paid us during the 12 months preceding the event giving rise to the damage;
- we are not liable for an error due to the assumptions or data entered, for use contrary to these terms, for a decision taken on the basis of a plan, nor for a failure of the Internet or of the client's equipment, nor for a case of force majeure (A14);
- these limits never apply to our intentional fault, fraud or gross fault, nor to those of our agents, nor to personal injury, nor where the law prohibits them.
A14. Force majeure. Neither party is liable for a delay or non-performance caused by an unforeseeable and irresistible event beyond its control (general failure of the Internet or of a host, large-scale cyberattack, decision of an authority). If the impediment lasts more than 30 days, either party may terminate at no cost.
A15. Ownership. Fiplan, its code, its texts, its templates and its brand remain the property of VAGA MART; the client receives a personal, non-exclusive and non-transferable right of use, for the duration of the subscription. The data entered remains the property of the client; the client authorises us to host and process it to provide the service, nothing else. We never use the content of a file for any other purpose.
A16. Confidentiality. Each party keeps confidential what it learns from the other. Nobody at Fiplan looks at a file, except at the client's request: support access is authorised by the client, read-only, for 48 hours at most, and it is logged.
A17. Personal data. Fiplan processes the data of its clients as controller (privacy policy). For the data the client enters about their own clients, Fiplan acts as processor (data processing agreement).
A18. Amendment of the terms. We may amend these terms. Any material amendment is announced by e-mail and in the application at least 30 days before it applies; a client who refuses it terminates at no cost before that date. The version in force is always dated on this page.
A19. Communications. Service e-mails (account, billing, security) are part of the contract and cannot be switched off. Invoices are electronic; they are drawn up in Dutch, the language of our establishment in Kortrijk (Flemish Decree of 19 July 1973), with a translation where useful.
A20. Miscellaneous. A void clause does not affect the others; it is replaced by the closest valid clause. Not exercising a right does not waive it. Fiplan may transfer the contract to a company it creates or controls and which takes over all its commitments, by informing the client by e-mail; for a private individual, article C9 applies. These terms exist in French, Dutch and English. The French text prevails; towards a private individual, in case of doubt, the interpretation most favourable to the private individual prevails.
A21. Governing law and disputes. The contract is governed by Belgian law. The parties first seek an amicable solution (write to support@fiplan.be). Failing that, the rules of Parts B and C apply.
Part B — For professionals
B1. Who. A professional is a natural or legal person who uses Fiplan for their professional activity and provides a valid VAT or company number. The person opening the account declares that they can bind the firm.
B2. No withdrawal, no refund. The right of withdrawal for distance contracts applies only to consumers. A period that has started remains due; termination takes effect at its end.
B3. VAT and invoices. Firm established in Belgium: Belgian VAT of 21%. Other country of the Union: reverse charge, the VAT number being checked with the European VIES system. Outside the Union: no Belgian VAT, with the legal mention on the invoice. Invoices to Belgian VAT-registered clients are structured electronic invoices (Peppol network).
B4. Indirect damage. In addition to the limits of article A13, Fiplan is not liable for indirect damage: loss of turnover, profit or clientele, damage to reputation, loss of data beyond restoring the last backup, a third-party claim.
B5. The firm's clients. The firm alone is answerable, towards its own clients, for the plans, reports and advice it gives them, even when produced with Fiplan. It indemnifies Fiplan against any claim by one of its clients relating to such a document, unless it arises from a failure by Fiplan to meet its own obligations; in that case, Fiplan's liability towards the firm follows articles A13 and B4.
B6. Users and client area. The firm creates and removes the accesses of its users and is answerable for their use. If it invites its clients to the client area, it decides what it shares, informs them of the processing of their data and closes their access when the relationship ends. Its clients accept the client area access conditions (section 6).
B7. Data of the firm's clients. The firm is the controller of the data it enters about its clients; Fiplan processes it as processor, under the data processing agreement (section 4), which forms part of the contract.
B8. Courts. Failing an amicable agreement, any dispute falls exclusively within the jurisdiction of the Enterprise Court of Ghent, Kortrijk division.
Part C — For private individuals residing in Belgium
C1. Who. A private individual is an adult natural person who uses Fiplan for private purposes and resides in Belgium. The offer to private individuals is reserved to Belgium.
C2. Prices. Displayed prices include VAT (21%); the total price is shown before the order, with no hidden costs. Example: Essentiel, €49.99 excl. VAT = €60.49 incl. VAT per month.
C3. Before and after the order. Before ordering, the private individual sees the summary (plan, price, term, trial, renewal, withdrawal). Afterwards, they receive by e-mail the confirmation of the contract and these terms on a durable medium.
C4. Right of withdrawal (14 days). The private individual may withdraw without giving reasons and at no cost within 14 calendar days of the conclusion of the contract (the sign-up). They do so:
- with the "withdraw from contract here" button (Settings › Subscription), available throughout the period, then "confirm withdrawal";
- or by e-mail to support@fiplan.be, or with the form below.
We acknowledge receipt without delay by e-mail, repeating the content of the declaration, with its date and time. We refund every amount paid within 14 days, by the same means of payment. The refund is in full, even if the service has already been used. Access closes on withdrawal; the data export remains possible for 30 days (A10).
C5. Guarantee of conformity. Fiplan provides a digital service that conforms to the contract throughout the subscription. In the event of a defect, the private individual is entitled to have it brought into conformity and, failing that, to a price reduction or to termination of the contract.
C6. Liability. The limits of article A13 apply to the private individual only to the extent the law allows: never in the case of gross or intentional fault by Fiplan or its agents, nor of non-performance of an obligation that constitutes a main performance under the contract, except in the case of force majeure. The rights the law guarantees to the private individual remain intact.
C8. Disputes. The private individual may contact the Consumer Mediation Service free of charge (mediationconsommateur.be). The competent courts are those designated by law.
C9. Transfer of the contract. Fiplan transfers the contract of a private individual only to a company that takes over all its commitments, without reducing their guarantees. The private individual is informed of this by e-mail.
C10. Changes. Towards a private individual, a change to these terms or to the price that is unfavourable to them applies only from the period following its announcement, made at least 30 days in advance, unless required by law. If a change to the service (A2) affects their use more than minorly, they may terminate at no cost within 30 days of the announcement or of the change, and the unused part of the paid period is refunded to them.
